What is an Extension of Stay based on Thai Family/Spouse?

These types of extension applications are submitted at a local Immigration office, but can only be approved at a regional level Immigration office. Therefore, make sure to pay attention to the requirements and the process for a successful extension application. While it may seem complicated, remember that we’ve got your back. Obtain a Non-Immigrant type O Visa

Ideally, first obtain either the single or multiple entry Non Immigrant O Visa from a Thai Embassy in your Country of residence.

Travel to Thailand

Once you obtain the Non-Immigrant Visa O, you have to travel to Thailand to activate it.

Prepare All the Documents

After you arrive in Thailand and activate your Non-Immigrant Visa O, prepare all of the needed documents to convert (or extend) your initial non-immigrant visa to a marriage visa.

Submitting your Thai Family/Spouse Extension Application

Submit all the necessary documents for the visa application. Your extension application can be submitted within the last 30 days of your current 90 day permission of stay

Wait for your Thai Family/Spouse Extension to be processed.

All you have to do now is wait for the 1 year Thai Family/Spouse extension to be issued. Your application may take 30 days to be considered and approved

What are the Qualifications for a Thai Family/Marriage Extension?

There are, of course, certain qualifications you have to meet to obtain a 1 year extension based on Thai Family/Spouse. The following are some requirements that you, as a foreigner, need to fulfil.

Legally Married to a Thai Citizen

Obviously, you have to be legally married to a Thai national. If you were married abroad, you or your Thai spouse must have registered your overseas marriage at your local district office (Amphoe).

Thai Family (Children)

The children must have been born in wedlock, or if unmarried, separated or divorced, you must have obtained a Court order granting you parental rights as the Father. Your name should also appear on the children’s birth certificates.

Financial Requirement

You must have deposited 400,000 THB in a Thai Bank account in your sole name, for at least 2 months prior to submitting the application, OR, proof of monthly overseas transfers of 40,000 BHT per month into a Thai Bank account, OR, a an Embassy income letter confirming an income of 40,000 BHT per month. Bank statements, updated Passbooks may also be required. However, if you are a foreign woman married to a Thai man, there is no financial requirement your 1 year marriage extension application.

Other Documents

For marriages to a Thai at a Thai Amphoe, you must provide your Thai marriage certificate know as a (Kor Ror 3) and an updated marriage registration certificate(Kor Ror 2).

If you were married abroad and registered your overseas marriage at an Amphoe, you must provide an updated marriage registration known as a (Kor Ror 22).

Important Information

We have listed several important pieces of information for you to know about the Thai Family/Spouse
extension applications.

1. Address notification – You must confirm your current address or residence to the nearest immigration office every 90 days. If you are not in the country when the report is due, after re-entry to Thailand, the next 90 day notification becomes due 89 days from the date of re-entry. The date of entry counts as day 1. These are commonly known as 90 day reports.

2. Re-entry Permit – If you intend to exit and re-enter Thailand during your 1 year extension of stay, you need to purchase either a single or multiple re-entry permit. These can be obtained from your local Immigration office or a Thai Internation airport. The re-entry permit keeps any remaining permission of stay from your extension valid on re-entry. The entry clearance office will permit you to stay until the expiry date of your extension. If you intend to stay in Thailand for the duration of your 1 year extension, then you do not need a re-entry permit.

3. Finances – The Thai Family/Spouse extension is valid for 1 year and can be renewed each and every year providing you meet the current financial requirements as per Immigration bureau orders
